Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and FitNest Ltd (“FitNest”, “we”, “us”) governing your access to and use of the FitNest mobile application, related websites that link to these Terms (including fitnesttraining.com), and our services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be able to form a legally binding contract and meet any minimum age requirement in your jurisdiction (typically at least 13 years, or higher where required). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts

You must provide accurate registration information and keep your account credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions and purchases

Certain features may require payment. Purchases made through Apple’s App Store are processed by Apple and are subject to Apple’s terms and your Apple ID subscription settings (including cancellations and refunds as described by Apple). Prices, billing cycles, and trial terms are shown at the point of purchase. Where billing occurs outside the App Store (for example some coach or web flows), the checkout screens and linked terms apply.

5. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted.

6. Acceptable use

You agree not to misuse the Service, including by: violating applicable law; infringing others’ rights; uploading malware; attempting to probe, scan, or test vulnerabilities; scraping or automated access that imposes unreasonable load; impersonating others; harassing users; or circumventing security or usage limits. We may suspend or terminate accounts that violate these rules.

7. Health and fitness disclaimer

The Service provides fitness and wellness information and tools. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified health professional before starting or changing an exercise program. Use of the Service is at your own risk.

8. AI and automated features

Some features use machine learning or automation. Outputs may be inaccurate or incomplete. You should not rely solely on automated suggestions for health or safety-critical decisions.

9. Third-party services

The Service may integrate with Apple Health, wearables, sign-in providers, and other third parties. Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party services.

10. Intellectual property

The Service, including software, branding, text, graphics, and design, is owned by FitNest or its licensors and is protected by intellectual property laws. Feedback you provide may be used by us without obligation to you.

11. Changes to the Service

We may modify, suspend, or discontinue features or the Service with reasonable notice where practicable. We may also update these Terms; the revised Terms will be posted with a new effective date. Continued use after changes constitutes acceptance unless applicable law requires otherwise.

12. Termination

You may stop using the Service at any time and may delete your account through in-app controls where available. We may suspend or terminate access for breach of these Terms, risk, or legal reasons. Provisions that by their nature should survive will survive termination.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, FitNest and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service is limited to the greater of amounts you paid us for the Service in the twelve months before the claim or fifty pounds sterling (£50), except where liability cannot be limited by law.

15. Indemnity

You will defend and indemnify FitNest against claims arising from your use of the Service, your content, or your violation of these Terms, subject to applicable law.

16. Governing law

These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules. Courts in England and Wales have exclusive jurisdiction, except that consumers in the EEA or UK may also have mandatory rights in their country of residence.
